1. Agreement to Terms
By accessing or using Hands2Hands ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, homeowners, and service professionals ("Pros") who access or use the Service.
2. Description of Service
Hands2Hands is an online marketplace that connects homeowners with licensed, insured service professionals for home improvement, repair, maintenance, and related services. The Service includes:
- Service request creation and matching with qualified Pros
- Bid submission, comparison, and acceptance tools
- Messaging between homeowners and Pros
- Job scheduling, progress tracking, and reviews
- Contractor verification and license validation
Hands2Hands is a marketplace only. We are not a party to the service agreement between you and your Pro.
3. Account Registration
3.1 Eligibility
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you meet this requirement. Pros must hold all licenses and insurance required by their jurisdiction.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password
- Notify us immediately of any unauthorized access or security breach
- Accept responsibility for all activities under your account
4. Subscription & Billing (Pros)
4.1 Plan Selection
Pros select a subscription plan (Base, Core, or Pro) that determines their monthly bid allocation and included features. New Pros may receive a limited-time trial. When the trial ends, a paid plan and valid payment method are required to continue bidding.
4.2 Payment Terms
All payments are processed securely through Stripe. Prices are listed in USD and are subject to change with 30 days' notice for existing subscribers. Subscriptions auto-renew monthly until canceled.
4.3 Refund Policy
Monthly subscription fees are non-refundable once charged, except as required by applicable law. Bid bundles purchased in-app are non-refundable but do not expire.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Misrepresent your identity, credentials, licenses, or affiliations
- Post false, misleading, or fraudulent service requests or bids
- Circumvent the platform to avoid fees or evade our verification process
- Solicit users for services unrelated to their requests
- Send spam, unsolicited communications, or harassment
- Distribute malware, viruses, or harmful code
- Attempt unauthorized access to any systems or networks
- Reverse engineer, decompile, or scrape the Service
6. User Content & Reviews
You retain ownership of content you post (photos, descriptions, reviews). By posting, you grant Hands2Hands a non-exclusive, royalty-free license to use, display, and distribute that content in connection with the Service. You are solely responsible for content you post and must not post anything unlawful, defamatory, or infringing on others' rights.
7. Marketplace Disclaimer
Hands2Hands is not responsible for the quality, safety, legality, or timeliness of work performed by Pros, nor for the accuracy of listings or service requests. We screen Pros through a verification process, but homeowners are responsible for evaluating and selecting their Pro. Any contract for services is directly between the homeowner and the Pro.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANDS2HANDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100).
10. Indemnification
You agree to defend, indemnify, and hold harmless Hands2Hands and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the Service, your user content, or your violation of these Terms.
11. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. All provisions which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Maryland for the resolution of any disputes.
13. Dispute Resolution
Before filing any claim, you agree to attempt to resolve disputes informally by contacting us through our support page. If informal resolution fails, any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms here and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
